JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 30-11-2016 Heard Mr. Gautam learned counsel for the petitioner and Mr. Dayal, learned A.P.P. for the State.

Petitioner prays for bail in Begusarai Town P.S. Case No. 347 of 2016, registered under Section 414 of the Indian Penal Code and under Sections 25(1-b)a, 26, 35 of the Arms Act.

Three persons riding a motorcycle was intercepted by the police and search was carried out. From the person of the petitioner one loaded country made pistol and one live cartridge were recovered. It is stated that the petitioner has no criminal antecedent. Co-accused Ravi Shankar Singh, who had one case to his credit has been set at liberty by this court vide order dated 28.10.2016, passed in Cr. Misc. No. 46953 of 2016. Petitioner is in custody since 28.7.2016.

Considering the facts and circumstances of the case, the petitioner, above-named is directed to be released on bail on furnishing bail

Patna High Court Cr.Misc. No.48391 of 2016 (2) dt.30-11-2016 bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount to the satisfaction of learned C.J.M., Begusarai in Begusarai Town P.S. Case No. 347 of 2016, subject to the following conditions: (i) One of the bailors shall be the own/close family members of the petitioner.

(ii) In case of framing of charge, the petitioners shall appear in person on each and every date fixed in the court below. In case of default in doing so on two consecutives occasions without any cogent/satisfactory reason, the Trial Court shall have liberty to cancel the bail bond of the petitioners and secure his arrest in accordance with law.
