Petitioners, who are in custody, seek bail in connection with Madhubani Town P.S. Case No. 311 of 2018 registered for the offences punishable under Sections 420, 406, 467, 468, 471, 34 of the Indian Penal Code and Section 37(C) of Prohibition of Bihar Excise Act, 2016.
Informant has alleged that while he was on night patrolling duty petitioner were coming on a car and when they were asked to stop the car for checking they did not stop and they were chased and apprehended and were found in intoxicate condition. They had also put a plate of government of India and
Patna High Court Cr.Misc. No.67357 of 2018(3) dt.28-11-2018 2/2 on search 59 pieces of mobile, 37 pieces of watch, 69 pieces of memory card were recovered from their possession for which they did not have any satisfactory explanation. It has been submitted on behalf of the petitioner that they had come for business purposes and also to see one of his close associate who had suffered fractured injury. It has been submitted that articles seized were their personal belonging. Petitioners have no criminal antecedent and they are in custody since 02.09.2018.
Considering the aforesaid fact and circumstances of the case, let the petitioners named above be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Excise Act, Madhubani in connection with Madhubani Town P.S. Case No. 311 of 2018.
