The petitioner apprehends his arrest in Murar P.S. Case No. 70 of 2016 registered for the offences punishable under Sections 353, 354 and other Sections of the Indian Penal Code. The Block Development Officer, Chaugai made allegation that the petitioner and others assembled at the block office and raised slogan against illegal distribution of kerosene oil coupon. It is further alleged that the petitioner and other accused persons used unparliamentary language and locked the office of the informant.
Learned counsel for the petitioner submits that from perusal of Annexure-4, it would appear that the petitioner has earlier filed complain for illegal distribution of kerosene oil. An
Patna High Court Cr.Misc. No.16260 of 2017 (2) dt.01-05-2017 2/2 enquiry was held and the allegation of the petitioner was found correct. The petitioner made peaceful protest. It is further submitted that enquiry was held and it was found that no violence took place during the peaceful procession but, the BDO lodged the case with exaggerated versions.
Considering the facts aforesaid and nature of allegation, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Buxar in Murar P.S. Case No. 70 of 2016, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J.) KKSINHA/- U T
