Petitioner, who is in custody, seeks bail in connection with Bettiah Muffasil P.S. Case No. 285 of 2018 registered for the offences punishable under Sections 376/511 of the Indian Penal Code and under Section 8 of the Prevention of Children from the Sexual Offences Assaulted Act.

Informant has alleged in her written complaint that accused tried to commit rape upon her when she was cutting grass along with her younger sister.

It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case. There is land dispute between the party and from the side of petitioner complaint case was earlier filed against the informant

Patna High Court Cr.Misc. No.67369 of 2018(2) dt.27-11-2018 2/2 party. It has been further submitted that from the injury report as contained in Annexure 2 of this petition no external injury has been found on the person of informant. Petitioner has no criminal antecedent and he is in custody since 12.06.2018. Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge-cum-Special Judge, Bettiah, West Champaran in connection with Bettiah Muffasil P.S. Case No. 285 of 2018.
