JUSTICE RAKESH KUMAR ORAL ORDER 14-10-2015 Heard Sri Chandra Kant, learned counsel for the petitioner and Sri Ram Anurag Singh, learned A.P.P. The petitioner, apprehending his arrest in connection with CIII Case No. 41 of 2014 registered for the offence punishable under Section 47A of the Excise Act, has prayed for grant of anticipatory bail.

Learned counsel for the petitioner submits that petitioner has falsely been implicated, and as such, there is every possibility that on false implication petitioner may be apprehended.

Learned A.P.P. has opposed the prayer of bail. In view of the facts and circumstances, particularly the

No.46124 of 2015 (2) dt.14-10-2015 2/2 nature of accusation, in the event of arrest or surrender within a period of eight weeks from today, let the petitioner namely Rajendra Sah be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan, in connection with CIII Case No. 41 of 2014 subject to the conditions as contemplated under Section 438(2) of the Code of Criminal Procedure.
