The petitioners seek anticipatory bail in a case instituted for the offence under Sections 147, 341, 307, 323, 447, 504 and 506 of the Indian Penal Code.
It has been submitted that occurrence took place on account of land disputes. The petitioner Nos. 1 to 4 are own brothers of the informant whereas petitioner Nos. 5 and 6 are Bhabhi and cousin of the informant.
From the written report it appears that there is general and omnibus allegation against the petitioners. It is stated that on
Patna High Court Cr.Misc. No.4956 of 2017 (2) dt.14-02-2017 2/2 the date of occurrence all the accused persons assaulted the informant on account of land dispute. The injury report is annexed as Annexure-2 wherein the doctor has found simple injury on the person of the informant. The injury report shows no any repetition of blow.
Considering the facts and circumstances of the case, let the petitioners above named in the event of surrender within six weeks from the date of receipt of this order, in connection with Kurtha P.S. Case No. 154 of 2016, shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Arwal, subject to the conditions as laid down under Section 438 (2) Cr.
