Petitioner seeks bail in Kako P.S. Case No.65 of 2018 instituted for the offence under Section(s) 307 and other allied sections of Indian Penal Code and Section 27 of the Arms Act.

Counsel for the petitioner submits that there is case and counter case between the parties.

In the instant case, it is alleged that this petitioner gave farsa blow on the head of informant. Counsel for the petitioner submits that this petitioner has also filed a counter case in which informant along with other persons have assaulted the petitioner and his family members brutally on account of land dispute for which Kako P.S. Case No.64 of 2018 has been

Patna High Court Cr.Misc. No.66639 of 2018(2) dt.19-11-2018 2/2 lodged.

Injury report of the informant has been enclosed as Annexure-3 from which it appears that the doctor has found one lacerated wound 11⁄2" x 1/2" on skull caused by hard and blunt substance.

Petitioner is in custody since 20.08.2018.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jehanabad, in connection with Kako P.S. Case No.65 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
