The petitioner seeks bail in a case registered for the offences punishable under sections 272, 273/34 of the Indian Penal Code and section 47-A of the Excise Act. 103 bottles of foreign liquor was recovered from possession of the petitioner.

Submission is that the petitioner has got no such criminal antecedent and he is in custody since 03.08.2016. Considering the entire facts, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Railway Judicial Magistrate Patna in connection with Danapur Rail (Bihta) P.S. Case No. 46

Patna High Court Cr.Misc. No.53248 of 2016 (2) dt.08-12-2016 2/2 of 2016, subject to the condition that the petitioner shall file an undertaking before the court below that he would not indulge in such activities in future.
