2. The petitioner seeks regular bail in connection with Phulwarisharif P.S. Case No. 1278 of 2024 dated 30.08.2024 registered for the offence(s) punishable under Sections 316(5), 318(4)/3(5) of the B.N.S.

3. The main submissions advanced by learned senior counsel appearing for the petitioner are that the petitioner has fair and clean antecedent and languishing in jail since 04.02.2025 and the instant matter relates to the misappropriation

No.20983 of 2025(2) dt.29-04-2025 2/3 of Rs. 48,10,315/- which was credited to Kurkuri PACS Samiti to purchase paddy for the financial year 2022-23, the petitioner was Chairman of the said Kurkuri PACS Samiti and in the present time the present president of Kurkuri PACS Samiti has entered into the compromise with the concerned bank and has deposited Rs. 10 lacs and assured to deposit the rest of the amount in four installments within four years and in this regard Annexure-3 may be perused and further the concerned bank (Patliputra Central Co-operative Bank Ltd.) has issued no objection certificate in favour of the Kurkuri PACS Samiti. It is lastly submitted that regarding the said settlement, a specific statement has been made in the paragraph no.11 of the petition.

4. Learned APP appearing for the State has opposed the bail prayer of the petitioner.

5. Considering the aforesaid submissions and mainly petitioner's statement made in the paragraph no.11 of the petition regarding the aforesaid settlement between the Kurkuri PACS and the concerned Bank in respect of the alleged misappropriated amount, this court is inclined to grant the relief of bail to the petitioner. Accordingly, let the petitioner namedabove be enlarged on bail in connection with Phulwarisharif P.S. Case No. 1278 of 2024 on furnishing bail bond of Rs. 20,000/-
