JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-09-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 420,406 and 120B/34 of the Indian Penal Code.

The prosecution case is that co accused Jitendra Kumar Srivastava and Sneha Srivastava being the Director and the owner of a non-banking financial company namely Global Investment Impax Company persuaded the informant to deposit rupees twenty five lacs but subsequently nine lacs rupees were returned but rest amount was not returned.

It is submitted by the learned counsel for the petitioner that there is no specific accusation against the petitioner and the petitioner is only collecting agent in the aforesaid non-banking

Considering the fact that the informant made investment in the company to which the petitioner was in no way related, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Bhojpur at Ara in connection with Ara Nawada P.S. Case No. 59 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Anil/- U T
