The petitioners, who are in custody, seek bail in connection with Teghra P.S.Case No. 115 of 2016 registered under Sections 341, 323, 337, 302 and 120B/34 of the Indian penal Code.
Allegation in brief is that accused persons were indulged in brick-batting and one accused Mukesh Kumar shot at the informant's wife causing her death.
Submission is that the petitioners have been falsely implicated due to some Panchayat Election dispute and the petitioners were not present at the place of occurrence and their names have been dragged, however, the specific allegation of killing by fire arms is against Mukesh Kumar and not against these
Patna High Court Cr.Misc. No.54890 of 2016 (5) dt.01-03-2017 2/2 two petitioners and the petitioners have no criminal antecedent except one case against petitioner no. 1 under minor sections of the penal code and they are in custody since 22.06.2016 and the police has also submitted the charge sheet after concluding the investigation in this case.
Having considered the aforesaid facts and circumstances, the petitioners, namely Anil Kunwar and Sonu Kunwar @ Sonu Kumar, are directed to be released on bail upon furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Teghra P.S.Case No.115 of 2016.
