The petitioner seeks modification of order dated 01.08.2018 passed in Cr.Misc. No.43237 of 2018, by which bail was earlier granted to him in connection with Rosera P.S. Case No.82 of 2018, with one of the conditions that one of the bailors will be his father.
Learned counsel for the petitioner submits that the father of the petitioner has declined to furnish bail bond in favour of the petitioner and, therefore, the said clause in the bail order may not be possible for the petitioner to furnish and he thus prays that the said clause be deleted. It is further submitted that in the modification petition it is specifically stated that the
Patna High Court Cr.Misc. No.65303 of 2018(2) dt.16-01-2019 2/2 petitioner is willing to furnish other sureties. In view of the practical difficulties and that the other conditions will be followed by the petitioner as undertaken by him, let the said Clause No.1 in the order dated 01.08.2018 be withdrawn.
The modification application stands disposed of accordingly.
