16-02-2017 A writ petition was filed with regard to misutilization of grant-in-aid given to the affiliated colleges which were required to pay remuneration to its employees. This Court directed the University to enquire into the matter and finalize the list, so that the governing body may not swindle the funds.

The petitioner of this contempt application was not the writ petitioners. He claimed that he was in the list as prepared by the University as far as in 1987. He was shown there as Lab Technician, he should, thus, have considered.

Patna High Court MJC No.4872 of 2011 (3) dt.16-02-2017 Sri P.K. Verma, learned senior counsel for the Veer Kunwar Singh University submits that petitioner of this petition, on enhancement of qualification became Lecturer, he thus, could not be considered as a Lab Technician any more.

Sri D. K. Singh, learned Senior counsel in support of the application submits that at least this much is clear that petitioner was on the roll of the college, and therefore, he must get payments.

Having considered the matter, in my view, the matters are disputed and such dispute cannot be resolved in contempt proceeding. It would be better for the petitioner to file appropriate application before appropriate forum and get the matter adjudicated.

In any view of the matter, the action of the University cannot be said to be contemptuous in any manner.

With this liberty and observation, this application stands disposed of.
