Case No. 04/14 where an offence punishable under section 376(G) of the Indian Penal Code was alleged. Apprehending their arrest, the petitioners filed A.B.A. No. 112/2014 in the court of Sessions Judge, Khagaria, and the same was dismissed on 4-4-2014. Hence, this application. Heard learned counsel for the petitioners and learned A.P.P. for the State.
It may be true that the exact date of the offence punishable under section 376(G) I.P.C. is not mentioned. The fact, however, remains that the informant gave the detailed account of state of affairs that created for her taking advantage of the fact that
Patna High Court Cr.Misc. No.25423 of 2014 (4) dt.25-06-2015 2/2 she is an orphan. The truth or otherwise of the allegations will be considered by the trial court. This Court is not inclined to grant anticipatory bail.
This petition is dismissed.
