JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-08-2016 Heard learned counsels for the petitioner and the State. The petitioner is languishing in jail since 10.05.2016 in a case registered for the offences punishable under Section 20 of the NDPS Act of the Indian Penal Code.

Three persons were intercepted while traveling on a motorcycle when one person escaped from the scene. The petitioners Suresh Kumar Ram and Ravi Kumar were apprehended when from the dickey of the motorcycle, 2.5 kgs. of ganja were recovered.

It is submitted by the learned counsel for the petitioners that the alleged motorcycle was registered in the name of coaccused Dilip who escaped from the scene, statement to that effect has been made in para 8 of the petition. A statement has been

Mr. J.N. Thakur, learned counsel for the State does not dispute the quantum of recovery.

Considering the recovery between small and commercial quantity when the motorcycle claimed to have been registered in the name of co-accused Dilip and statement made in para 3 of the petition that the petitioners have no criminal antecedent, let the above named petitioners be released on bail on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge, NDPS Act, Purnea in connection with Special Case NO. 01 of 2016 arising out of Baisi P.S. Case No. 59 of 2016. Learned court below will be at liberty to cancel the bail bonds of the petitioner if he defaults for two consecutive occasions or substantially gets involved in some serious nature of offence.
