2. The petitioner seeks regular bail in connection with Majorganj P.S. Case No. 422 of 2024 registered for the offence under Sections 317(5) of the Bharatiya Nyaya Sanhita, 2023 and sections 25(1-B)a, 26 and 35 of the Arms Act.

3. As per the prosecution case, one country made pistol and two live cartridges were recovered from the possession of the co-accused Md. Anwarul Alam.

4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is in custody since 13.12.2024. The petitioner was not caught on the spot. Nothing incriminating has been recovered from the possession of the petitioner.

5. Learned A.P.P. has vehemently opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, 1st, Sitamarhi/concerned Court below in connection with Majorganj P.S. Case No. 422 of 2024 subject to condition that:- (i). The petitioner will mark his attendance at the Majorganj Police Station on the first & third Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.

8. The application for bail stands allowed.
