Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 272, 273, 420 of the Indian Penal Code and 47A of the Excise Act. It is alleged that the 1500 sachets of country made liquor were recovered from a Pick-up Van, when one person was apprehended, who suggests the name of co-accused Bharat Yadav and revealed that the illicit liquor was manufactured in Annapurna Rice Mill. The petitioner is the owner of the said rice mill. The premises of the rice mill was also raided, from where 9200 sachets of country made liquor, each containing 200 ml., spirit, two automatic machines, wrapper and other articles were recovered.
Patna High Court Cr.Misc. No.38774 of 2015 (2) dt.29-09-2015 It is submitted by the learned counsel for the petitioner that prior to the seizure, the petitioner leased out the mill to some other person and other co-accused persons have been granted bail.
Let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Nawanagar P.S. Case No. 87 of 2014, pending in the court of learned Chief Judicial Magistrate, Buxar.
With the above observation this application is disposed of.
