JUSTICE SUDHIR SINGH ORAL ORDER 01-11-2018 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is apprehending his arrest in a case for the offence registered under Sections 307, 120(B)/34 of the IPC and 27 of the Arms Act.

The prosecution story, in brief, is that the informant near Kelabari Pool from where she was passing on Motorcycle with Shivendra Kumar. Co-accused Bam Bam Singh fired on her with intention to kill her. She received bullet injury on her left side of back. The petitioner also made firing thereafter, both accused persons fled away. Shivendra Kumar carried her to hospital on a Tempo.

It has been submitted by learned counsel for the

Patna High Court Cr.Misc. No.66194 of 2018 (2) dt.01-11-2018 2/2 petitioner that the petitioner has falsely been implicated in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The main allegation of causing injury upon the victim is against co-accused Bambam Singh who is alleged to have fired. No injury is attributed against the petitioner. Due to previous enmity, the petitioner has been made in the present case.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, in the event of arrest or surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M. Rosera, Samastipur, in connection with Bithan P.S. Case No. 83 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
