JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ---------------- 30-04-2015 Heard learned counsel for the petitioners and the learned A.P.P. for the State as also learned counsel for the informant. The petitioners apprehend their arrest in connection with Buniyadganj P.S. Case No.39 of 2014 (G.R. No.1962 of 2014) registered under Section 366 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioners submits that on the basis of the written report of the informant, Rakiba Khatoon, the mother of the victim, Anjum Khatoon, the present case was instituted under Section 366 of the Indian Penal Code regarding the kidnapping of Anjum Khatoon, against
Patna High Court Cr.Misc. No.47588 of 2014 (2) dt.30-04-2015 2/2 unknown. While in course of investigation, several witnesses have raised suspicion about the involvement of the petitioners in the kidnapping of the victim, Anjum Khatoon, the daughter of the informant, Rakiba Khatoon, but the victim, Anjum Khatoon, in her statement recorded under Section 164 of the Code of Criminal Procedure on 20.05.2014 has only stated that she was taken away by Danish Raza and has not stated anything regarding the involvement of the petitioners in her kidnapping. Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within four weeks, be enlarged on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Smt. Vijya, Judicial Magistrate, 1st Class, Gaya, in connection with Buniyadganj P.S. Case No.39 of 2014 (G.R. No.1962 of 2014), subject to the conditions laid down under Section 438(2) Cr.P.C.
