The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 341, 323, 324, 307, 379, 504 of the Indian Penal Code.
The prosecution case is that the accused persons came variously armed and co-accused Baiju Sao with garasa assaulted on the head of the informant, Suraj Sao and Jagarnath Sao assaulted with iron rod to Govind Sao on his head, the petitioners Rajesh Sah and Mahesh Sao assaulted the son of the informant with iron rod on his head, Usha Devi and Kiran Devi took out gold chain and ear ring, Baiju Sao took out Rs. 35,000/- and Rajesh Sao
Patna High Court Cr.Misc. No.38786 of 2015 (2) dt.30-09-2015 also took out Rs. 37,000/- from the shop of the informant. It is submitted by the learned counsel for the petitioners that the injury of the informant and his son has been found simple and Doctor has found only two bruises on the left parietal and left side of the scalp superficial, simple in nature. There is counter version of the occurrence. Statement has been made in para-3 of the petition that petitioners have no criminal antecedent Considering the aforesaid facts, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Aurangabad (Moffasil) P.S. Case No. 102 of 2015, subject to conditions as laid down under Section 438(2) of the Indian Penal Code. (Dinesh Kumar Singh, J) P.K./- U T
