JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-386, 387, 388/34 of the Indian Penal Code and 17 of the CLA Act.

Taking into consideration that the petitioner was caught red handed, while he had gone to collect levy and furthermore, the petitioner does have criminal antecedent and appears to be member of Indian Communist Party (Marxist), I am not inclined to release the petitioner on bail and accordingly, his prayer for bail in connection with Alipur P.S. Case No. 14 of 2016 stands rejected.
