The petitioner is languishing in custody since 14.02.2019 in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The prosecution case is that from the roof of the house of the petitioner, about 10 litres of Indian Made Foreign Liquor were recovered.
It is submitted by learned counsel for the petitioner that the recovery has been made from the joint family house of the petitioner. A statement has been in paragraph no.3 of the petition that the petitioner is involved in two other cases of similar nature, but he is on bail only in one out of the two cases. Learned APP submits that the recovery has been made from the house of the petitioner.
