Petitioners seek bail in a case registered under section 273 of the Indian Penal Code and section 47(a) of the Bihar Excise Act. Petitioners were caught while they were carrying Indian made foreign liquors by a car and for the aforesaid offence, they were remanded in jail custody since 23.9.2016.

No doubt, petitioner no.2 was granted provisional bail on 22.11.2016 for a limited period but taking note of this fact that the petitioners have sufficiently been punished by remaining in jail custody since long and apart from this, petitioners do not have any criminal antecedent.

Accordingly, petitioners are directed to be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the
