Heard learned counsel for the petitioner and learned A.P.P for the State.

The petitioner seeks bail in Baliya (Ballia) P.S. Case No. 270 of 2013 corresponding to Sessions Trial No. 113 of 2019, registered for the offence punishable under Sections 307, 302 and allied sections of the Indian Penal Code and section 27 of the Arms Act.

Earlier the bail application of petitioner was rejected vide order dated 07.12.2020. Vide order dated 07.07.2021, report was called for regarding the stage of trial and same has been received (kept at flag 'C'), from which it appears that case is running on prosecution evidence.

Patna High Court CR. MISC. No.32775 of 2021(3) dt.25-08-2021 2/2 Considering the nature of allegation and stage of trial, I am not inclined to enlarge the petitioner above-named on bail. Accordingly, the same is rejected.

However, as the petitioner is in custody since 16.07.2018, trial court is directed to conclude the trial within a period of nine months from the date of receipt/production of a copy of this order.
