The petitioner apprehends his arrest in Garkha P.S. Case No. 301 of 2021, registered for the offences punishable under Sections 307, 379 and other allied sections of the Indian Penal Code and section 27 of the Arms Act.
As per the FIR, petitioner is alleged to have resorted to fire, but no one sustained firearm injury. It is submitted that petitioner has been falsely implicated in this case. Entire allegation is false and concocted. In fact, petitioner gave advance for supply of bricks to the informant, but neither bricks were supplied nor money was returned and the informant lodged this false case against petitioner and others, so that, this petitioner may not demand the
Patna High Court CR. MISC. No.21620 of 2022(2) dt.05-09-2022 2/2 advance money from the informant. Petitioner claims clean antecedent.
Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Saran at Chapra in connection with Garkha P.S. Case No. 301 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
