JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 395, 397, 412, 216(k) of the Indian Penal Code.

The name of petitioner came in this case on the basis of information given by spy of the police. Subsequently, petitioner was arrested and Rs. 1,10,000/- in cash were recovered from his house. The confessional statement of petitioner was recorded and accordingly, he was remanded in the present case. Submission on behalf of the petitioner is that petitioner has not been put on Test Identification Parade as yet and

Patna High Court Cr.Misc. No.39866 of 2016 (3) dt.18-11-2016 2/2 so far as seized money is concerned, the same belongs to the petitioner. It is also submitted that having more or less similar allegation, one co-accused, Umesh Gond @ Umesh Gor has already been granted privilege of bail.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Bagaha, West Champaran in connection with Dhanaha P.S.
