JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-06-2019 This is an application for grant of anticipatory bail in connection with Danapur P.S. Case No. 644 of 2018 for the offences under Sections 420, 468, 120(B) of the Indian Penal Code, Section 63 of the Copyright Act, 1957 and Section 103, 104 of the Trade Mark Act, 1999.

Prosecution story is that the shops of the co-accused persons were raided where huge quantity of duplicate parts and mobile were recovered and they disclosed the name of the petitioner Raj Kumar @ Pappu and of the petitioner Sanjay @ Sanjay Kumar Gupta.

Submission of the learned counsel for the petitioners is that in both cases nothing has been recovered from their shops and they have falsely been implicated in this case only on the suspicion and having no criminal antecedent. Petitioner Sanjay

Patna High Court CR. MISC. No.19195 of 2019(5) dt.20-06-2019 2/2 @ Sanjay Kumar Gupta was allowed provisional bail vide order dated 02.04.2019.

Heard learned A.P.P. also.

Having heard both sides, considering the above submission, both applications are allowed. The provisional bail granted to the petitioner Sanjay @ Sanjay Kumar Gupta vide order dated 02.04.2019 is confirmed.

So far as the petitioner Raj Kumar @ Pappu is concerned, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M.-I, Danapur, in connection with Danapur P.S. Case No. 644 of 2018 subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
