Petitioner seeks bail in a case registered for the offences punishable under Section 302 of the Indian Penal Code and 27 of the Arms Act.

Petitioner is assailant of the deceased. Informant is father of the deceased. Mother of the deceased has also supported the allegation before the police as eye witness of the occurrence.

Learned counsel for the petitioner submits that in fact neither the informant nor his wife is witness of the occurrence. They have cooked up a story after the occurrence. Considering the nature of allegation and material available, I am not inclined to enlarge the petitioner on

Patna High Court CR. MISC. No.19830 of 2019(3) dt.03-06-2019 2/2 bail for the present in connection with Gogari P.S.Case No.208 of 2018 pending in the court of learned Chief Judicial Magistrate, Khagaria. Hence, prayer is refused. Learned Trial Court is directed to expedite the trial.
