1. The defects, as pointed out by the office, are hereby ignored.
2. Heard learned counsel for the petitioner and learned APP for the State.
3. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 341, 323, 307, 385, 387, 504, 506, 427, 379 and 34 of the Indian Penal Code and Section 27 of the Arms Act.
4. The learned counsel for the petitioner submits that the petitioner has antecedent of one case and informant alleges that she was extending the height of the boundary of her purchased house, when the accused persons along with the
Patna High Court CR. MISC. No.31757 of 2024(2) dt.26-07-2024 2/3 petitioner and 20-25 unknown accused came and demanded extortion of Rs. One Crore, on protest, it is alleged that accused persons assaulted the informant and snatched her golden chain and behaved inappropriately and even fired, but missed.
5. The learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that the dispute is in between Ashok Bhagat and husband of the informant with regard to the land which Ashok sold to the husband of the informant. It is also submitted that there is no specific allegation against the petitioner and petitioner has no concern with Ashok, but has been made an accused in the instant case as he had filed a Complaint Case No.1359 of 2023 against the informant under Section 138 of the N. I. Act read with Section 406 and 420 of the I.P.C. which is pending adjudication in the Court of the learned A.C.J.M.-IV, Patna City, Patna.
6. Learned A.P.P. opposes the anticipatory bail application.
7. Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail
Patna High Court CR. MISC. No.31757 of 2024(2) dt.26-07-2024 3/3 on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-IV, Patna City, Patna in connection with Agam Kuan P. S. Case No.994 of 2023, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
8. The application stands allowed.
