JUSTICE RAVI RANJAN ORAL ORDER 04-12-2015 Heard learned counsel for the petitioner and the State. Petitioner seeks direction to the respondents for grant of P.D.S. licence to the petitioner on compassionate ground by taking follow-up action as required by the District Compassionate Selection Committee(Supply) (hereinafter referred to as "the Committee"), vide paragraph 11 of Annexure 6. It is contended that despite the direction of the Committee, the Sub-Divisional Officer, Gopalganj has not submitted the required documents and file of the petitioner for final consideration of the matter by the Committee.

Patna High Court CWJC No.14243 of 2015 (2) dt.04-12-2015 It appears that the Sub-Divisional Officer, Gopalganj has already written vide Annexure-7 dated 08.12.2014 enclosing necessary documents for sympathetic consideration of petitioner's case. The District Supply Officer happens to be the secretary of the Committee as per the provisions contained in the Bihar Public Distribution System(Control) Order, 2001 and, as such, he would be required to put up this matter before the Committee concerned for taking proper decision in the matter. Petitioner's claim is that no decision has been taken by the Committee till date.

Having regard to the facts and circumstances, this Court would be inclined to dispose of the petition with a direction to the committee concerned to consider the case of the petitioner in accordance with law and take a final decision regarding selection on compassionate ground within a period of two months from the date of receipt/production of a copy of this order.
