The petitioner seeks bail in Kundwachainpur P.S. Case No. 103/2016, registered for the offences punishable under Sections 272 and 273 of the Indian Penal Code and Section 30(a) and 37(a) of the Bihar Excise Act.
The police intercepted an auto-rickshaw in which eight persons were travelling but seeing the police the passengers started to flee away. All the eight persons were apprehended and 1500 pouches, each containing 300ml Nepali country made liquor, were recovered.
Learned counsel for the petitioner submits that the petitioner is a passenger and he has got no manner of concern with
Patna High Court Cr.Misc. No.54451 of 2016 (2) dt.10-01-2017 2/2 the recovered country made liquor from the auto-rickshaw. The petitioner is in jail since 24.10.2016.
Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Sikrahana at Dhaka, East Champaran in connection with Kundwachainpur P.S. Case No. 103/2016.
