====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 24-06-2020 Heard Mr. Bijay Prakash Singh, learned counsel for the petitioners and Mr. Prem Kumar Jha, learned APP for the State.

The petitioners, who are in custody since 28.02.2020 and are persons of clean antecedents, seek bail in connection with Siwan Mufassil P. S. Case No. 102 of 2020 dated 27.02.2020 instituted for the offences under Sections 272 and 273 of the Indian Penal Code and Sections 30 (a) and 41 (1) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

Patna High Court CR. MISC. No.19585 of 2020(2) dt.24-06-2020 2/2 It appears that 154.405 litres of liquor has been recovered from a Tempo vehicle which has been saddled on the petitioners.

The learned counsel for the petitioners submits that they have got no concern with the aforesaid recovery and they have wrongly been made accused in the present case. Regard being had to the period of custody of the petitioners and their clean antecedents, they are directed to be released on bail on their furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge cum Special Judge, Excise, Siwan in connection with Siwan Mufassil P. S. Case No. 102 of The petition stands allowed.
