JUSTICE PRABHAT KUMAR JHA ORAL ORDER 09-02-2017 This writ petition is filed for quashing the order dated 07.10.2005, contained in Annexure-5, by which the petitioner was dismissed from the service and the subsequent order passed in the appeal confirming the order of termination of the petitioner. The learned counsel for the Biscomaun at the very out set of argument submitted that the Biscomaun is a co-operative society and runs by its Managing Committee. The government has not superseded or appointed any Administrator for the management of the Biscomaun and, as such, the writ petition is not maintainable against the Biscomaun. It has been held in the judgment of Organiser Dehri C.D. & C.M. Union Ltd. Vs. State of Bihar reported in 2014 (1) PLJR 695.
Learned counsel for the petitioner, as such, seeks
Patna High Court CWJC No.4042 of 2009 (2) dt.09-02-2017 2/2 permission to withdraw this writ petition to avail the appropriate remedy under the law.
Accordingly, this writ petition is dismissed as withdrawn.
