====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 19-12-2018 Heard Sri Abhimanyu Sharma, learned counsel for the petitioner and Sri Damodar Prasad Tiwary, learned Additional Public Prosecutor.

This is second attempt for grant of bail on behalf of the petitioner. Earlier, by order dated- 07.05.2018 passed in Cr. Misc. No. 27361 of 2018 the bail petition of the petitioner stood dismissed as withdrawn. It was submitted by learned counsel for the petitioner that in the present case i.e. Vaishali ( Belsar ) O.P. P.S. Case No. 112 of 2017, G.R. No. 1798 of 2018 corresponding to T.R. No. 3647 of 2018 petitioner is in custody since 04.05.2017 which was registered for the offence under Section 411/ 413/ 414/34 of the Indian Penal Code, 1860 and under Section 25 (1-b)a/ 26 / 35 of the Arms Act, 1959. According to learned counsel for the petitioner, since petitioner

No.69635 of 2018(3) dt.19-12-2018 2/2 in the year 2017 had filed a complaint petition against the Officer- in- charge of Bhagwanpur Police Station and other Police Officers, Police vindictively has arrayed the petitioner as accused in about eight cases which fact has been stated in paragraph no. 3 of the petition. He submits that except the present case, petitioner is on bail in all other cases. Be that as it may, considering the nature of accusation in the present case as well as period of custody, let the petitioner Bhim Sahni be enlarged on bail on furnishing bail bond of Rs. 10,000/- ( ten thousand ) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate IV, Hajipur at Vaishali / concerned court in connection with T.R. No. 3647 of 2018 (G.R. No. 1798 of 2018), arising out of Vaishali ( Belsar ) O.P. P.S. Case No. 112 of 2017.
