JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-10-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147,148,149,323,504 and 379 of the Indian Penal Code and section 3(1)(x) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act.

The prosecution case is that the accused persons entered into the house of the informant, abused her by calling caste name and tried to outrage her modesty. It is alleged that on the order of co accused Vijay Prasad Keshari, co accused Lal Babu Keshari and Astami Keshari assaulted the informant with fists and slaps. The accused persons took away the box of the informant.

No.43851 of 2015 (3) dt.30-10-2015 2/2 It is submitted by the learned counsel for the petitioners that the accusation has been levelled in the background of litigated relationship between the parties and for the occurrence of 27.9.2014 the FIR was registered on 7.12.2014. It is further submitted that at earlier point of time petitioner Kashi Prasad Keshari lodged Kudra P.S. Case No. 19 of 2014 and Complaint Case No. 451 of 2013 against the informant side. Considering the delayed lodging of the case and the case lodged by the petitioners side at earlier in point of time, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Kaimur at Bhabua in connection with Kudra P.S. Case No.259 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Anil/- U T
