Petitioner apprehend her arrest in Mahua P.S. Case No.410 of 2018, registered under Sections 341, 323, 504, 354, 448, 427, 379 and 34 of the Indian Penal Code. The informant alleged that his sister-in-law, Meena Devi, wife of his elder brother after his death solemnized marriage with Sanjay Singh. Meena Devi and Sanjay Singh killed the first wife of Sanjay Singh for which a case was registered under Section 302 of the Indian Penal Code. It is further alleged that Meena Devi even after her second marriage came and wanted to get the share of his brother and for that Meena Devi, her father and brothers came and assaulted the informant and others including his wife.

Patna High Court CR. MISC. No.22251 of 2019(2) dt.11-04-2019 2/2 Learned counsel for the petitioner submits that no specific allegation of assault is made against the petitioner. There is a counter version bearing Mahua P.S. Case No.409 of 2018 which was registered on the fardbeyan of the petitioner. In fact no occurrence as alleged by the informant had ever taken place.

Taking into consideration the facts that there is a case and counter case and the petitioner is own sister-in-law of the informant, it appears that on account of some family dispute, both the sides had entered into scuffle and lodged case and counter case, let petitioner, above named, who is a lady, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Vaishali at Hajipur in connection with Mahua P.S.
