Having regard to the fact that the petitioner in this writ application has assailed an order of suspension and now during the pendency of this writ application the departmental enquiry against him has already been completed, this Court without entering into the merit of the order of suspension would direct the competent authority to take a final decision which would conclude departmental proceeding against the petitioner. Since the petitioner claims to have already filed his reply to the show cause enclosing the enquiry report, it will be necessary for the disciplinary authority to pass final order in the departmental proceeding at an early date, preferably within a period of three

Patna High Court CWJC No.21320 of 2014 (3) dt.24-07-2015 months from the date of receipt of this order, so that the fate of the order of suspension of the petitioner is also ultimately decided as per result of the disciplinary authority.

With the aforementioned observation and direction, this application is disposed of.

Let the records of C.W.J.C.No. 13821/2014 be placed before this bench immediately which on account of petitioner being placed under suspension impugned herein has already become infructuous.
