2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 30 (a) of Bihar Prohibition and Excise Act.
3 . It is alleged that 20 liters illicit liquor was recovered from an open place .
4. It is submitted that the petitioner is innocent and has falsely been implicated in this case only on the basis of suspicion . Recovery has been made from open place which is accessible to one and all. No incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the aforesaid recovery . Petitioner has

5 . Learned counsel for the State opposes the bail petition.
6. Considering the fact that recovery has been made from open place and other circumstances of case , in the event of arrest/surrender within eight weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive special Judge Excise First Saran in connection with Chapra Muffasil Police Station Case No. 647 of 2024 , subject to the conditions laid down under section 482 ( 2 ) of BNSS 2023 .
