The petitioner prays for anticipatory bail in connection Ishipur (Barahat) PS case no. 25 of 2016 registered for the offence punishable under various sections 188, 420, 353, 201 of Indian Penal Code.
It is submitted on behalf of petitioner that the period for which, documents have been called for, the petitioner was not the Panchayat Secretary of Rafatpur Block at that time as he has joined in the year 2012 and he has annexed the charge report as Annexure-3 which shows that those papers has not been handed over to the petitioner for the period 2005-06. In similar case, he has been charged for non-submission of the documents for the year 2008, in which, he has been granted anticipatory bail and thereafter, he has deposited the
Patna High Court Cr.Misc. No.8838 of 2017 (3) dt.20-03-2017 2/2 documents.
Heard learned A.P.P. also. Learned A.P.P. has opposed the prayer for bail.
Having heard both sides. In view of the submissions and stand taken by the petitioner, let the petitioner, named above, in the event of his arrest or surrender in the Court within a period of two weeks from the date of receipt/ production of a copy of this order, be released on bail on furnishing bail bond of Rs. 25,000/-(Rs. Twenty five thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur in connection with Ishipur (Barahat) PS case no. 25 of 2016 subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions that petitioner shall co-operate in the investigation of the case and will produce whatever documents he has and shows the same to investigating officer also and if he fails to show it to investigating officer or did not cooperate in the investigation, the prosecution shall be free to move for cancellation of his bail bonds. With these observations, this bail application is allowed.
