Petitioner seeks bail in Ujiyarpur P.S. Case No.134 of 2018 instituted for the offence under Section(s) 272, 273 Indian Penal Code and Sections 47, 30(a), 38(i), 38(2) of the Bihar Prohibition & Excise Act.
Counsel for the petitioner submits that there is no any recovery of foreign liquor from possession of the petitioner. In the written report, it is alleged that in course of search from the Banswari in front of house of Santosh Kumar @ Golu and behind the house of Albu, 24 pieces of Royal Stag each of 750 ML have been recovered. It is further alleged that foreign liquor of different brands have also been recovered from beneath one tree and Kelwani of Santosh Kumar.
Patna High Court Cr.Misc. No.66657 of 2018(3) dt.20-11-2018 2/2 Petitioner is in custody since 12.09.2018.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the 3rd Additional Sessions Judgecum-Special Judge, Excise, Samastipur, in connection with Ujiyarpur P.S.
