This application for anticipatory bail arises out of Mansahi P.S. Case No. 126 of 2018 for the offence punishable under Sections 147, 341, 323, 325, 307, 354, 379 and 504 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner has submitted that old dispute between the parties is the reason behind lodging of the case. A scuffle, according to him, had taken place, in which, informant's side of this case was the aggressor. It is also submitted that the parties are agnates. It is evident from the First Information Report that the dispute between the parties is long drawn.
Considering the above submission and the nature of accusation keeping in mind the genesis of occurrence, this application is allowed.
Patna High Court CR. MISC. No.19898 of 2019(2) dt.01-04-2019 2/2 Let the petitioner above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Katihar in Mansahi P.S. Case No. 126 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
