2. This is the second attempt of the petitioner for grant of regular bail in connection with Rajepur P.S. Case No. 250 of 2023 registered for the offence under Sections 302, 120(B), 34 of the Indian Penal Code.

3. As per the prosecution case, one Jagga Ray was killed by the accused persons. The petitioner in his selfinculpatory statement has confessed his guilt and given details of the crime.

4. The petitioner is in jail since 28.10.2023.

5. Learned counsel for the petitioner very fairly submits that trial is progressing and in the trial two witnesses have been examined.

6. Considering the role played by the petitioner in the murder, this Court is not inclined to grant bail to the petitioner.

7. Accordingly, this application is dismissed.

8. The Superintendent of Police, East Champaran is directed to ensure the appearance of the witnesses in the trial. The trial Judge is also directed to conclude the trial of the petitioner at the earliest.

9. It is, however, clarified that the observations made herein are limited to the adjudication of the present bail application and shall not prejudice the case of the petitioner at any subsequent stage of the trial and this Court has not expressed any opinion on the merits of the case.

10. Let a copy of this order be communicated to the Principal District and Sessions Judge, East Champaran through FAX for its compliance.
