JUSTICE SANJAY PRIYA ORAL ORDER 14-02-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks anticipatory bail in a case instituted for the offence under Sections 47, 54 and 57 of the Bihar Excise Amendment Act, 2016.

It has been submitted that nothing has been recovered from the possession of the petitioner. The name of the petitioner has been disclosed by the co-accused Satish Singh during investigation, from whose house, the foreign liquor is alleged to have been recovered.

From the written report, it appears that the petitioner is not named. Further, in the written report, it appears that there is no recovery of any foreign liquor made from the possession of the petitioner. The seizure list has been enclosed which shows that the

Considering the facts and circumstances of the case, let the petitioner above named in the event of surrender within six weeks from the date of receipt of this order, in connection with Alouli P.S. Case No. 229 of 2016, shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
