Mr.Chandra Bhushan Prasad ====================================================== CORAM: HONOURABLE MR. JUSTICE SANDEEP KUMAR ORAL ORDER 24-05-2023 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Jokihat P.S. Case No. 525 of 2022 for the offence under Sections 341, 323, 325, 307, 302, 34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 30.01.2023.

As per F.I.R., the petitioner along with accused persons was quarreling with informant's mother Masooma Khatoon on which the informant and his father Md. Irshad Alam both came at home to resolve the dispute. In the meantime, Tahjeev and other co-accused repeated blow of iron rod and assaulted the informant and his family members which caused

The petitioner is not named in the F.I.R. and the allegation against the petitioner is general and omnibus. The only allegation of assaulting the informant and his family members against accused Md. Tahjeev.

Considering the fact that the petitioner has got no criminal antecedent, the petitioner, named above, is directed to be released on bail after framing of charge on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Jokihat P.S. Case No. 525 of 2022.
