JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 26-05-2015 The petitioners apprehend arrest in Baroon P.S. Case No. 108 of 2014 registered under section 366A/370 OF THE Indian Penal Code, pending before the Chief Judicial Magistrate, Aurangabad.

Learned counsel for the petitioners draws attention of this court to the fact that the first information report has been instituted after fifteen days of the occurrence. He further draws attention of this court to the statement recorded under section 164 Cr.P.C.as given by the victim girl to show that it was clearly a case of elopement and not kidnapping. He points out that the girl was fully prepared to go with the boy. She took the

No.47597 of 2014 (2) dt.26-05-2015 2/2 thing in a suitcase, with the boy on a motorcycle and she travel to Gujrat and stayed there for about 15 days and thereafter she came back. She lived with in her parent's house near about fifteen days and thereafter she was brought to the court by police for recording her statement under section 164 Cr.P.C.

Considering the aforesaid facts, the above named petitioners in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Chief Judicial magistrate, Aurangabad in connection Barun P.S. Case no. 108 pf 2014, subject to the conditions as laid down under section 438(2) Cr.P.C.
