JUSTICE ARVIND SRIVASTAVA ORAL ORDER 22-03-2017 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.

This application, for grant of anticipatory bail, arises out of Alauli Police Station Case No. 34 of 2016/ G.R. No. 282 of 2016, disclosing offences under Sections 406, 467, 468, 471, 420, 120(B) and 419 of the Indian Penal Code. Learned counsel for the petitioner has submitted that the petitioner, who is clean antecedent, has falsely been implicated in this case due to land dispute and village politics. In fact the, petitioner happens to be one of the bonafide seller of land of his share. As such, no case is made out against him. Moreover, co-accused, Ram Bilash Yadav, Mukho Yadav and Sanjay Yadav, having more or less similar allegation, have

Patna High Court Cr.Misc. No.10389 of 2017 (2) dt.22-03-2017 already been granted bail by a co-ordinate Bench of this Court in Cr. Misc. No. 4000 of 2017. Hence, the petitioner deserves the privilege of anticipatory bail.

Considering the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria, in connection with Alauli Police Station Case No. 34 of 2016/ G.R. No. 282 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
