Petitioner seeks regular bail in connection with Excise Case No. 239 of 2021 registered for the offence under Section 30 (a) of the Bihar Prohibition and Excise Act 2016. The prosecution report lodged by Excise Official is that on the basis of secret information the house of the petitioner was raided and a total quantity of 97.92 liters of illicit foreign liquor was recovered from the same.
Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case with oblique motive and the house from where illicit liquor was recovered is a joint family property and other family members also reside
Patna High Court CR. MISC. No.31922 of 2021(2) dt.14-12-2021 2/2 therein. Learned counsel next submits that petitioner is in custody since 14/03/2021 having no criminal antecedent of similar nature of offence and charge sheet has already been submitted.
Regard being had to the submissions made by the parties and taking into consideration the materials available on record, the fact that petitioner is in custody since 14-03-2021 and charge sheet has already been submitted, I am inclined to grant regular bail to the petitioner.
Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 10000/- ( ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II -cumSpecial Judge (Excise), Jehanabad in connection with Excise Case No. 239 of 2021.
