The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 147, 149, 341, 323, 379, 427, 386, 435, 504, 506 of the Indian Penal Code. The informant alleges that while he was on duty when fourteen FIR named accused persons along with 20-25 unknown came variously armed with lathi and danda at the sand ghat and started crossing the tractors from the barrier and when the informant protested, it is alleged that all accused persons abused and assaulted him, it is further alleged that on orders of Deepak Singh, Chotu and Rajeshwar Singh set blaze the room of the informant and looted money.
Learned counsel for the petitioners submits that the
Patna High Court CR. MISC. No.22950 of 2023(2) dt.12-07-2023 2/2 petitioner No. 1 and 2 have antecedent of one case and petitioner No. 3 is a person with clean antecedent.
Learned counsel for the petitioners submits that the petitioners have been falsely implicated in the present case, it is next submitted that the allegations are general and omnibus in nature and similarly situated co-accused has been granted the privilege of anticipatory bail by order dated 28.02.2022 in Cr. Misc. No. 29856 of 2021.
Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Barun P.S. Case No. 57 of 2020 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
