2. The petitioner apprehends his arrest in a case registered for the offence under Section 414 of the I.P.C. and section 30(a) of Bihar Prohibition and Excise Act.
3. As per F.I.R., 375 ml. Whisky has been recovered from the Vikram (Tempo), of which, this petitioner is registered owner.
4. Learned counsel for the petitioner submits that though, petitioner is registered owner of alleged vehicle, but has got no concern with the illicit liquor. In fact, petitioner has already sold his vehicle to one Niraj Kumar on 04.11.2011 (Annexure P/2). He further submits that no incriminating article has been recovered from possession of this petitioner. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State has opposed the bail petition.
6. Considering the quantity of recovery, clean antecedent and the facts & circumstances of the case, let the above named petitioner, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. 1-cum-Additional District and Sessions Judge, Vaishali at Hajipur in connection with Sadar @ Hajipur Sadar @ Hajipur Sadar (Kazipur) P.S.
