JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 307 and other allied sections of the Indian Penal Code and Section 108 of Railway Act. Petitioner was made accused in a case which was lodged in the year 1996 and it appears that he was granted bail in the aforesaid case but subsequently, he made himself absent from the proceeding resulting cancellation of his bail bond on 07.09.2007. Subsequently, petitioner voluntarily surrendered before the court below on 23.01.2016 and since then he is languishing in jail custody.

Considering the aforesaid facts and circumstances as

No.39177 of 2016 (3) dt.26-09-2016 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-I, Ara in connection with Sessions Trial No. 294 of 1996 arising out of Behiya P.S. Case No. 06 of 1996, subject to condition that one of the sureties must be close relative of the petitioner, who shall swear an affidavit before the court below as to how he is related with the petitioner.
